TERMS AND CONDITIONS
These are our terms and conditions for any orders placed at Big Tree Designs.
Please read these purchasing terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Big Tree Designs makes these products available to you. If you do not accept these terms and conditions you may not purchase any products from Big Tree Designs. Any purchase from you on this website, indicates your express agreement to be bound by these terms and conditions.
PRICING
The price of the items excludes any shipping or delivery charge. Nor does it include insurance for goods in transit
AVAILABILITY
We will try our utmost to ensure availability, but there are times when certain products may be out of stock. In that case, you will be given the opportunity to place those items on back order. You will be notified when they are back in stock again and given preference to purchase. If you decide against the alternatives, we will ship available items less the out of stock items or cancel the order if you prefer to do so. Your credit card will not be charged until we ship your order, and you will not be charged for out-of-stock items.
ACCEPTANCE
We will acknowledge your order via email. Our acceptance of an order takes place on dispatch of the order, at which point the purchase contract will be made and you will be charged.
DELIVERY
Subject to availability and receipt of payment, delivery will be made to the address specified by you as delivery address in your account profile.
We do our best to secure delivery within 4 days of the date of your order but will not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control. Sea freight shipments will take approximately 6 weeks to arrive at the nearest port.
All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the goods will be retained by the courier, in which case notification of the attempted delivery will be given. The courier service will subsequently arrange a suitable time for delivery, will return later or on the following working day.
RETURNS
Big Tree Designs guarantees the quality of all our products and your satisfaction is our foremost priority. If for any reason you are dissatisfied with your order, please contact us within 3 days of receipt of your order.
All returned goods are to be accompanied by a RETURNS # which will be emailed to you.
All goods are to be returned unopened and in their original packaging.
All returned goods are subject to a 15% re-stocking fee.
Returned orders are subject to the dispatch and return shipment charges.These charges must be paid by you.
However, if the product is found to be faulty in any respect, we will waive the re-stocking fee and will re-imburse all the returns shipping charges incurred i.r.o this item
REFUNDS
Big Tree Designs processes refunds to the credit card used at the time of purchase upon receiving your returned shipment. Please allow 30 days for the refund to appear on your credit card statement. If you have made payment by any other means we will transfer the refund via EFT.
PAYMENTS
Payment may be made via Visa, Master Card credit cards, cash deposit or by electronic funds transfer into the Big Tree Designs’ bank account, the details of which will be provided during checkout.
NO CHEQUE PAYMENTS are accepted.
CREDIT CARD ACQUIRING AND SECURITY
Credit card transactions will be acquired for Big Tree Designs by PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the Big Tree Designs’ website. Users may go to www.paygate.co.za to view their security certificate and security policy. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. PayGate’s Internet servers are protected by firewalls and intrusion detection systems.
CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by Big Tree Designs separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate, refer to www.paygate.co.za.
MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).
RESPONSIBILITY
Big Tree Designs takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Our liability to you in connection with any order will not exceed the total price charged for the relevant items and the shipping costs.
YOUR PRIVACY
Big Tree Designs has taken all reasonable steps to protect the personal information of it’s clients. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded here.

You may not use the Big Tree Designs website for any purpose that is unlawful or prohibited by these terms. You may not use this website in any manner which could damage, disable, overburden, or impair it or interfere with any other party’s use and enjoyment of it.
COUNTRY OF DOMICILE
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes will be decided only by South African courts.
If any of the above mentioned terms or conditions are held by a court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
